Tenants Can Form an RTM Company and Control Their Building – Here’s How

- The building must include at least two separate flats.
- No more than 25% of the floor space (not counting common areas, halls, stairs, or car parks) should be used for commercial purposes.
- At least two-thirds (66%) of the flats must be owned by qualifying tenants with leases originally longer than 21 years.
- The RTM company must have at least one director and two members, who are qualifying residents.
- At least half (50%) of the qualifying tenants must agree to join the company before a claim notice is sent to the landlord.
- You can set up the RTM company earlier, but it can only issue a claim notice once the 50% support level is reached.

- The building was not originally built as a block of flats (it’s a converted property, not purpose-built).
- There are four or fewer flats in the building.
- The freeholder (or a close family member) has lived in one of the flats as their main home for at least 12 months.
